However, not everything went as planned by the Tezos team. Arthur and Kathleen Breitman, while establishing Tezos’ successful ICO, established the official Tezos Foundation in Switzerland. The situation quickly became complicated thanks to Swiss law stating that the board members of foundations must be independent – which means while the Foundation itself would be able to purchase intellectual property from Dynamic Ledger Solutions, the Breitmans could not sit on the foundation’s board.
As a result, Johann Gevers – the founder of the Crypto Valley association – was quickly appointed as head of the board instead of Breitmans themselves. In the Swiss legal system, which offers loose ownership statutes, this meant that Gevers gained control of the Foundation.

Later, Reuters reported that Arthur and Kathleen Breitman submitted a 46-page letter to the Tezos Foundation board, calling for Gerver’s immediate dismissal and demanding that the couple play a “substantial role” in a new structure.
The Breitman’s attorney accused Gervers of “self-dealing, self-promotion and conflicts of interest,” and demanded his suspension for a month, to which Gervers reportedly protested.
Gevers argued that the Breitmans were trying to exert control over the project, which goes against the decentralized structure they were trying to build. Gervers refused to step down, and subsequently, four different class-action lawsuits were filed.
However, Tezos’ development did not cease during the Breitmans’ long-lasting legal battle with Gervers. It was only when the Breitmans recovered control of the project’s source code that they were able to resume working on the project. Also, Gervers stepped down eventually, and the conflict settled in March of 2018. This controversy caused a lot of problems for those that invested in the ICO as Tezos lost half of its value. Interestingly, all these incidents showed that Tezos’ team was not completely safe from the problem they were trying to solve — i.e., division.
